These Terms of Use ("Terms") govern your access to and use of Depwa, including its website, features, content, search tools, profiles, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms and our Privacy Policy.
1. Who may use Depwa
You must be at least 13 years old to create an account or submit information through Depwa. If you are under 18, you represent that you have permission from a parent or legal guardian to use the Service and that they have reviewed these Terms with you. We do not knowingly permit children under 13 to create accounts.
If you create or manage a professional artist or salon profile, you also represent that you are legally permitted to offer, manage, or promote the applicable services and that all information you provide is accurate.
2. What Depwa provides
Depwa is a visual discovery and directory platform. It helps users explore nail inspiration, find similar looks, and discover independent nail artists and salons. Depwa is not a salon, employer, staffing agency, booking service, payment processor, or provider of beauty services.
Artists and salons are independent third parties. Depwa does not control or guarantee their licensing, availability, pricing, safety, service quality, conduct, or results. You are responsible for evaluating a professional before booking or receiving services.
3. Accounts and account security
You are responsible for maintaining the security of your sign-in method and for activity associated with your account. You agree to provide accurate information, keep it reasonably current, and notify Depwa if you believe your account has been accessed without authorization.
A person may not impersonate another individual or business, create deceptive profiles, claim a salon or portfolio without authority, or use another person's content without permission.
4. Artist and salon profiles
Professional profiles and salon listings may include names, service areas, specialties, portfolio photos, booking links, contact details, and affiliations. Profile owners and managers are responsible for keeping this information accurate. A professional may be associated with only the salon relationships supported by the Service.
Depwa may verify, correct, limit, mark as unclaimed, suspend, or remove listings when information appears inaccurate, duplicated, outdated, unauthorized, misleading, or connected to a permanently closed business.
5. Your content
You retain ownership of photos, text, profile information, and other content you submit ("User Content"). You represent that you own the User Content or have all permissions needed to submit it and allow Depwa to use it as described here.
For content intended to appear publicly—such as portfolio photos, profile photos, salon information, and approved client-submitted photos—you grant Depwa a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, resize, format, distribute, and otherwise use that content to operate, improve, and promote the Service. This license ends when the content is deleted, except for reasonable backup, legal, fraud-prevention, and enforcement needs.
Inspiration photos uploaded only for visual search are treated as private search inputs. Depwa may store, process, resize, analyze, and compare them only as reasonably necessary to provide, secure, troubleshoot, and improve the matching feature, as described in the Privacy Policy. They are not added to a public profile unless you separately choose to submit them for publication.
6. Content standards
You may not upload or submit content that:
- you do not own or have permission to use;
- infringes intellectual-property, privacy, or publicity rights;
- is fraudulent, deceptive, defamatory, threatening, or unlawful;
- contains malware, harmful code, or attempts to disrupt the Service;
- contains unauthorized advertising, pricing, QR codes, watermarks, usernames, or promotional text where Depwa requires unbranded portfolio work;
- misrepresents AI-generated, stock, stolen, or another professional's work as your own; or
- contains sexual, exploitative, abusive, or otherwise inappropriate material.
7. Client-submitted photos and credit
A client may be able to submit a photo and credit an artist or salon. Publication may require approval by the credited professional. Approval does not transfer ownership, prove authorship, or guarantee that the submission is accurate. Depwa may remove or relabel a submission if ownership, consent, authenticity, or attribution is disputed.
8. Visual matching, AI, and moderation
Depwa may use automated systems, visual analysis, artificial intelligence, metadata, location, and human review to rank similar looks, detect prohibited content, screen submissions, reduce duplicates, and assist with verification. Results are estimates and may be incomplete, delayed, inaccurate, or change as the system is improved.
A match label, ranking, verification indicator, or moderation result is not a professional endorsement, guarantee of authorship, or promise that an artist can reproduce a particular design.
9. Location and availability
Location features may prioritize listings near a city, ZIP code, or device location. Distance estimates and market availability may be approximate. Depwa may launch in limited beta markets and may still show inspiration from professionals outside your selected area.
10. Third-party links, bookings, and payments
Depwa may link to third-party websites, booking platforms, social profiles, maps, or payment services. Your use of those services is governed by their own terms and privacy practices. Depwa is not a party to appointments, payments, cancellations, refunds, disputes, injuries, or services arranged through a third party.
11. Moderation and enforcement
Depwa may review, restrict, reject, remove, preserve, or disclose content when reasonably necessary to operate the Service, enforce these Terms, protect users, investigate misuse, comply with law, or respond to valid legal requests. We are not obligated to monitor every submission and cannot guarantee that all content is accurate or appropriate.
12. Intellectual-property reports
If you believe content on Depwa infringes your rights, contact us with the content location, a description of the protected work, your contact information, and an explanation of your claim. We may request additional information and may remove disputed content while reviewing the report.
13. Suspension and termination
You may stop using Depwa at any time and may request account deletion through available account tools or the contact method below. Depwa may suspend or terminate access when an account violates these Terms, creates risk, is fraudulent, is inactive where permitted, or when needed to protect the Service or comply with law.
14. Service changes and availability
Depwa is an evolving beta service. Features, markets, content, limits, eligibility rules, and availability may change. We do not promise uninterrupted or error-free operation and may modify or discontinue features at any time.
15. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available." Depwa disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Nothing in these Terms excludes rights or warranties that cannot legally be excluded.
16. Limitation of liability
To the fullest extent permitted by law, Depwa will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, personal-service disputes, or losses arising from third-party professionals, salons, links, bookings, or content. Depwa's total liability for a claim relating to the Service will not exceed the greater of $100 or the amount you paid Depwa, if any, during the 12 months before the event giving rise to the claim.
17. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold Depwa harmless from claims, losses, and reasonable costs arising from your User Content, your professional services, your violation of these Terms, or your violation of another person's rights. This section does not apply where prohibited by law.
18. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Mandatory consumer protections in your place of residence continue to apply where required by law.
19. Changes to these Terms
We may update these Terms as Depwa evolves. We will post the revised version and update the effective date. If a change is material, we may provide an additional notice. Continuing to use the Service after the updated Terms take effect means you accept them.
